Ralph Shaw called the meeting to order at 6:55 p.m.
Post Hearing Agenda:
1. Administrative Approval (SE 43-2443) Pinsoneault, 92 Cayuga Ave Rd: The agent described the request from Casey Landscaping to change the location of the staircase leading to the pond so as to avoid cutting down two additional trees (1 birch and 1 maple). The staircase will now jog to the right midway down the bank as opposed to the left, hence avoiding cutting of additional trees.
Motion made, seconded and unanimously carried to approve this admin request.
2. Administrative Approval (SE 43-2362) John Harris, 97 James Circle: The agent described the request from Atlantic Development and Construction Company to make changes to the previously approved retaining wall layout on the original site plan. Instead of having retaining walls with 8 ft + drop offs, a tiered retaining wall layout built with typical landscape stones will be put in place with each wall having a height of 4-5 ft. Additional request for small retaining wall on opposite side of house.

Hearing Agenda:
7:00 p.m. Thomas Young, 15 Mutiny Way (RDA): The agent described the RDA involving an upgrade to a septic system. The resource area is Isolated Land Subject To Flooding. The agent recommended a negative determination.

7:03 p.m. Jamie Weinstein, 387 Monomoscoy Rd (AOC): Christopher Costa & Assoc represented the client and described the project. The project calls for the revised design of proposed single family home, proposed leaching facility and the addition of an in-ground pool and proposed barn. The representative said that the lot would be kept 30% naturally vegetated. The agent asked about the bedroom above the barn and the representative informed the commission that the barn bedroom is temporary and will only be used for accommodations by the owner until his new house in complete. The representative went on to say that once the house is completed, the bedroom will be removed and the space will be used strictly for storage. The agent recommended approval

7:06 p.m. Terry Martorana, 374 Monomoscoy Rd (NOI): Don Schall represented the client and described the project. The project calls for the reconstruction of an existing boat slip, installation of sheet piling to protect the bank and a timber landing for access and minor dredging to open the slip entrance. The representative told the commission that the slip was originally constructed prior to 1970 and thus pre dates Mashpee’s conservation regulations (i.e. grandfathered). Mitigation is proposed to replant any disturbed areas of coastal bank, Land Subject to Coastal Storm Flow and salt marsh with native vegetation akin to what is lost. Mr. Schall read a letter from Rick York (Shellfish Constable) to the commission in which Mr. York gave his endorsement for this project.
The agent told the commission that the Mashpee Harbor Master (Perry Ellis) also gave his endorsement for this project. The agent recommended approval.

7:09 p.m. Poponnessett Beach Association, Dean’s Pond (NOI): Kieth Cassel of Aquatic Control Technologies represented the client and described the project. The project calls for the implementation of an integrated Aquatic Management Program to control the non-native shoreline/ wetland plants common reed and purple loosestrife. Mr. Cassel described the herbicide as glycophate based (rodeo) and treatment procedures would involve “spot on” applications (directly on the targeted plants). Len Pinaud inquired as to the potential adverse impacts of this herbicide to the aquatic life in Dean’s Pond. Mr. Cassel said using the spot on application technique would minimize the adverse impacts. The agent and Len Pinaud still expressed concerns over the
impacts of this herbicide and inquired as to alternative application methods to reduce possible adverse effects. Mr. Cassel informed the commission that a “cut-stem, paint on” approach could be used for the phragmites application as opposed to a sprayer/ injector application. Mr. Cassel went on to say that this application method could not be used when it comes to the purple loosestrife and would have to use the “spot on” technique for those invasives. The agent recommended approval.

7:12 p.m. Edward Gildea, 194 Wading Place Rd (RDA): John Slavinsky from Cape & Islands Engineering represented the client and described the project. The project calls for the removal of existing septic tank and installation of a new septic tank for existing house expansion. The agent recommended a negative determination.

7:15 p.m. Punkhorn Realty LLC, 80 Punkhorn Point Rd (AOC)- John Slavinsky from Cape & Islands Engineering represented the client and described the project. Mr. Slavinsky presented an extensive landscape plan prepared by Michael Talbot and Associates to the commission. The agent recommended approval
Motion made, seconded and unanimously carried to approve this AOC.
7:18 p.m. John Donnellan, 59 Pond Circle (RDA) The agent described the project on behalf of the client. The project calls for the construction of a 5’ X 6’ wooden platform for entering and exiting a boat. The proposed area for the platform is a barren stretch of bank bordering the canal separating Pond Circle and Sunset Circle off John’s Pond. Jeff Cross asked if the platform was to be anchored into the ground and Mr. Donnellan said no, it would be seasonal. The agent recommended a negative determination.

7:21 p.m. Nancy & Richard Cook, 401 Monomoscoy Rd (NOI continued from 4/5/07). Falmouth Engineering sent in a letter to the commission requesting a continuance. Rick York (Shellfish Constable) had issues with the size of the float attached to the dock/pier. In a letter read to the commission from Mr. York, he explained how the proposed float size would make shell fishing difficult, if not impossible in that area. Falmouth Engineering revised the plans to address Mr. York’s concerns; however, the plans were not submitted 5 days prior to this hearing, hence the need for a continuance.
Motion made, seconded and unanimously carried to approve a continuance to 5/3/07 @ 7:18 p.m.
7:24 p.m. Baypoint LLC, Great Oak Road (AOC). Gardens by Rebecca represented the client and described the project involving requested changes to the landscape plan including construction of stonewalls at the entrance to the condos and additional plantings. The agent recommended approval.
